Using chessbase during live games

Let us be clear about this, if you are a low rate and use database against titled player it is against rules.
If you are a titled player and you do this against lower rated it is Okay.
I definitely will use chessbase for playing games, only thing is I can't afford it
This case is very clear: the user used chessbase database. But lichess do not ban such users. Instead it bans the users by a different algorithm.

Lichess identify the users who studied openings and ban them if they do several moves by theory.
So, do not study any databases. Play 1. a3 a6. And you will not be banned.
Don’t spread bullshit @arbiterchess Millions of metadata points are considered. The AI is more intelligent than some cheaters might think.
Ok, It seemed like that if you were a title player and you cheat, you get warning only.
If you are unknown free user , you will get banned.
What about patrons? Will they get banned or warning.
If patrons cheats and dont get banned , a lot of cheaters might be interested in paying $ 5,$10.. :D
I think the „evidence“ is somewhat muddy. Ok, lights, reflections, beeps, speech... processed in the most ballyhoo way - I would bet on no one. He could have opened some other programs or websites. Think „they“ are erring on the side of caution and gave just a „Draconian warning“.
